Terms of purchase and sale

By paying a prepayment confirmation, you confirm the content of the order and agree to our terms and conditions of purchase and sale.

You also confirm that all data provided to us is correct.

All necessary changes and remarks must be made before the final confirmation of receipt is received. If you want to cancel or change the order after receipt of the final order confirmation, CustomKitchen has the right to charge for the work already started and materials purchased.

 

Until payment of the total cost, all the products remain the property of CustomKitchen.

 

 

 

Prices and payment

All prices are in euro (€) inclusive of VAT, unless otherwise noted.

The order is paid on the basis of the invoice submitted. The production of countertops will be started when the following conditions are met:

If we perform the measuring, prepayment is made in the amount of 30–100% of the total cost.

In case of customer’s drawing or his/her own measurements, the prepayment amount is 100% of the total cost.

When the countertops have been installed and you have received the job, a final invoice will be sent to you with a 10-day payment deadline.

In case of an unpaid invoice, a reminder fee of €6 + and interest at an interest rate of 8% per annum is added. In the event of continued non-payment, the case will be sent to the cash collector and the fee will be added to the invoice. Thereafter, fees may be added to other legal services and expenses.

Terms of sale

Price offer is valid for 30 days, unless otherwise stated in the offer.

The pricing is based on the CustomKitchen’s current material, production, and transportation costs. By notifying the customer in advance, CustomKitchen reserves the right to change the price quoted, in the event that the need arises due to circumstances beyond the control of CustomKitchen such as changes in currency rates and/or changes in material and/or production and/or transportation prices.

By confirming the order, you confirm the content of the order and you agree to our terms of purchase and sale. The order is confirmed and put into work after payment of the prepayment.

If you want to cancel or change the order after receipt of the final order confirmation, CustomKitchen has the right to charge for the work already started and materials purchased.

To change or cancel an order send an email to the following address: …. @ customkitchen.eu. When changing and order, you will receive a new order confirmation, the accuracy of which you must confirm again.

The order is deemed to be cancelled if the order is not confirmed within 30 days after the survey. CustomKitchen has the right to ask for a fee for the work started.

Before the payment of the total cost, all the products belong to the CustomKitchen.

 

 

 

Measurement

    • • For measuring, it is necessary that the cabinets or other substructure are installed.
      Measuring “from the air” is not possible.
    • • The area to be measured must be prepared for measuring, i.e. cleaned and well lit.
    • • Temporary or existing countertops must not be mounted on the cabinets. Cabinets must be attached to the wall and must not be replaced or removed after the survey..
    • • The base on which the countertop is installed must be smooth and level. The whole supporting surface has a tolerance of +/- 2mm.
    • • If you want to use other types of countertops together with the stone countertop, these must be installed before taking measurements.
    • • Do not install additional materials on the wall, such as plaster, stucco or tile plates, as this affects the final dimensions of the countertop.
    • • Data on the desired material, edge processing, corner bends, openings and their layout must be submitted at the latest at the moment of measurement. We cannot guarantee that the changes that are submitted later will be fulfilled.
    • • Data about the sink, tap, stove and their layout must be submitted at the latest at the time of the measurement, unless otherwise agreed.
    • • The person taking the measurements will give you instructions on whether and where you need to install additional supports.
    • • At the time of the measurement, the customer or his/her representative must be present at the site and give and receive information about the countertop and its measurement/installation.

The customer or his/her representative must indicate on the spot the location of different openings (i.e. sink and stove), otherwise they will be installed in the centre of the cabinet.

The person performing the measuring shall assess the moving route of the stone countertop and, as appropriate, adjust the size of the components. If necessary, additional assistance or lifting equipment is needed for bringing the stone countertop inside, for which an additional fee may be added.

If the above conditions are not met, CustomKitchen has the right to terminate the job and ask for a fee for the work that was already started.

If you want to make a product according to your own measurements or drawing, you will have to pay 100% prepayment, plus a possible fee for preparing a production drawing.

 

 

Installation

  • • The installation site must be prepared for installation, i.e. cleaned and well lit.
  • • There must be no temporary or existing surfaces on the cabinets.
  • • Our installation does not include electrical or plumbing work. It also does not include silicone joints with existing walls, tiling or other surfaces.
  • • Additional support must be fitted in accordance with the instructions given during measuring.
  • • There must be no tiling or other materials installed on the wall, because these would interfere with the installation of stone countertop.
  • • The support on which the countertop is installed, must be smooth and level. Tolerance of the entire base surface may not be greater than +/-2mm. In case of unevenness, supporting wedges will be used as necessary, which may leave visible gaps between the countertop and the cabinet.
  • • Installers will wear protective shoes and you can cover the floors for cleanliness and to avoid scratches.
  • • At the moment of installation, the client or his/her representative must be present on the site, in order to answer questions if necessary, and to receive the work at the end of the installation
  • • The stone and installation works must be checked immediately after installation and any possible deficiencies should be immediately reported to the installers. The deficiencies must be photographed and the pictures sent along with a short description to: info@customkitchen.eu. If the final customer or his/her representative is not present at the site after the installation, the installation work and the material is considered to be approved and work accepted by the final customer.
  • • CustomKitchen is not responsible for the time when you cannot use the kitchen or other areas because your countertop is still being manufactured

If the above conditions are not met, CustomKitchen has the right to terminate the job and ask for a fee for the work begun, material produced and/or for recurring visits.

In case you have ordered the installation without our measurement, you are responsible for the accuracy and suitability of all measurements. You are also responsible that the stone countertop can be transported and installed in the room. If the conditions are not met, we have the right to leave the ordered item in a suitable place for us and to consider the installation as complete.

 

 

 

Production

Stone is a natural material, and therefore the final size of the product is limited.

CustomKitchen always tries to meet your wishes, but the manufacturing of the product you want may be obstructed for the following reasons:

  • • Shape and size affect the durability of the material.
  • • Due to size, the stone cannot be safely processed.
  • • Size of the raw material does not allow its production.
  • • Size of the final countertop does not allow its installation.
  • • Due to the size of the final countertop, it is not possible to process it on machines.

 

 

CustomKitchen’s quality standard for stone countertops

        • • Squareness +/- 2%
        • • Flexibility +/- 2 mm
        • • Thickness variation of the same order +/-2mm. The front edges of the countertops may be calibrated to uniform thickness.
        • • Size difference for length +/-3mm, and width +/-2mm
        • • Surface tolerance for recessed sink or stove +/-2mm
      • • Tolerance of the edge extending from countertop +/-3mm (measured from the reference point)

 

  • Colour and texture irregularities

    Stone is a natural material and therefore the final material cannot be compared to one single sample. The following natural “defects” may occur more often:

    • • Small air bubbles are very common, for example, in Carrara marble and appear in small light bulbs, holes or grooves.
    • • Small, unpolished spots or cones may appear in polished granite, and their presence is affected by granite type and colour.
    • • Brighter lines that resemble crackers may appear.
    • • In a granite with a thicker pattern, clearer anomalies may occur in the form of stains, but no larger than 3cm.
    • • Some tone differences may occur between the different pieces of the same order, regardless of the fact that the final pieces are produced from the same material batch.

    Thus, the “deficiencies” caused by natural disparities cannot be claimed. Claims for small repairs made on the stone are not accepted.

    It is important to take into account that differences in quality, durability and colour may occur between materials ordered at different times.

 

 

  • Delivery times and transportation

    Since all our products are manufactured to order, we can only determine the expected delivery time and this should be considered as an approximate time from the completion of the order to the completion of the goods.
    CustomKitchen’s priority is to adhere to specified delivery times.

  • In case of delays, we will notify you as soon as possible.

  • Delivery times can also be affected by circumstances that CustomKitchen could not foresee or influence. CustomKitchen is not liable for any delays or additional costs in a situation beyond the control of CustomKitchen.

  • When concluding timely agreements with third parties, you should take into account possible delays and plan the times accordingly. CustomKitchen is not responsible for any additional costs that may be incurred in this situation.

  • If the goods are separately shipped to the address specified by a transportation company, the unloading of the goods will be carried out with a lift truck and the recipient of the goods must provide access to his property. Transportation of goods ends with unloading. The goods are left at the place indicated by the customer and the transport is deemed to be terminated.

  • If there are special products on the order (products that do not belong to the CustomKitchen’s standard assortment), you will not be entitled to cancel your order if you have a late delivery.

     

    CustomKitchen reserves the right to postpone the start of production in the following cases:

  • • CustomKitchen’s delivery terms are changed by the end customer or its agent.
  • • The name of the desired material or the data necessary for its processing has not been transmitted to us.
  • • We have not received the necessary advance payment.

 

 

  • Transportation conditions

    On receipt of goods, you must check the goods as follows:

    • • Make sure the item marked on the delivery note matches your order.
    • • Carefully check and make sure that there is no visible damage to the goods or the pallet.
    • • Otherwise check as prescribed by law.

    In case you discover any damage to the packaging or the goods or a discrepancy in the materials or quantity, you must write a written note on the transportation company’s waybill. In addition, you must take a photo of the detected damage and send it with a short description to: info@customkitchen.eu. When the goods have been accepted, you can no longer submit the corresponding claims.

    Goods that cannot be handed over due to the recipient (e.g. the recipient is absent at the agreed time), are returned to the sender and the recipient must pay an additional transport fee.

 

 

 

  • Return of goods

    Goods may be returned only by written agreement. Goods must be returned in the same condition, in their original packaging and packaged in the same manner as at the time of delivery to the customer. If the above conditions are not met, the goods cannot be returned. The cost of returning the goods is borne by the customer.

     

 

 

 

 

 

  • Complains

    Product deficiencies and faults must be immediately notified to address: … @customkitchen.eu. When products are being installed, any product deficiencies must be also orally reported to the installers.

  • A claim must contain precise descriptions of errors and/or deficiencies along with photographic evidence.

  • When you have accepted the goods, you do not have any further right to submit claims.

      It is important to take into account that differences in quality, durability and colour may occur between materials ordered at different times.

      In addition, claims regarding the following variations are not accepted:

      • • Minor scratches on the marble.
      • • Variations on the edges or surfaces due to the difference in the crystals.
      • • Rust stains may occur in some stones, which generally disappear over time.
      • • Possible roughness of the unprocessed cut edges.

 

 

 

  • Force majeure

    Failure to comply or improper performance of obligations under the agreement by CustomKitchen will not be considered a breach of contract if it was due to the occurrence of Force Majeure or unforeseen events that CustomKitchen could not control, influence or prevent.

     

     

     

    Limitation of liability and warranty

    For all stone tops, a 5-year warranty applies if the damage is due to installation, material or manufacturing defects. The warranty does not apply if the damage has been caused by modification or misuse of the customer. CustomKitchen is required to repair/reprocess/replace a product within a reasonable time and without additional charge or offer financial compensation in case CustomKitchen is responsible for any particular error or defect.

  • In a situation where the customer cannot use the product due to product defects or faults, CustomKitchen is not required to compensate for any losses or expenses caused to the customer, including loss of productivity, loss of revenue, or any additional costs. Limitation of liability does not apply to intent or gross negligence.

  • CustomKitchen’s sales representatives will advise you on the properties and uses of different materials. However, this advice cannot be considered a guarantee. As a customer, you also need to carefully evaluate whether the particular material and product is suitable for you to use.

  • CustomKitchen is not responsible for the functionality of the kitchens.

  • If CustomKitchen has not acknowledged in writing its fault or damage in respect to any damage caused to the claimant, the compensation offered by CustomKitchen should be considered as a statement of goodwill, rather than considered as an error or confession of guilt.

    In a situation where CustomKitchen has erroneously entered incorrect data (including due to a typo) on the price quotation or the order confirmation, the incorrectly marked data is considered to be data that was actually considered. CustomKitchen must notify the customer about changed data (e.g., increase in price), and in case of unsuitability the customer has the right to cancel the order.
